Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you and Koby Empire, Inc. (app developer), concerning your access to and use of the Sunflower website and related services. By accessing the site, you agree to be bound by these Terms of Use.

Intellectual Property Rights

The Site, including all content and marks, is our proprietary property protected by copyright and trademark laws. You are granted a limited license to access and use the site for personal, non-commercial use only.

User Representations

By using the Site, you represent and warrant that you are of legal age, will provide accurate information, and will not use the Site for any illegal or unauthorized purpose.

Prohibited Activities

Users are prohibited from actions such as data mining, uploading malicious code, impersonating others, or any activity that interferes with the Site's functionality or violates applicable laws.

Submissions

Any submissions you make to the Site become our sole property. We shall own exclusive rights and be entitled to unrestricted use of these submissions.

Site Management

We reserve the right to monitor the Site, take appropriate legal action against violations, and manage the Site to protect our rights and property.

SMS Messaging

The Services may include an AI-powered SMS text messaging feature that allows users to exchange text-based messages with Sam. Sam is an automated system and does not provide medical, clinical, or emergency services. Phone numbers collected for SMS messaging are used to provide the messaging service and are not sold or shared with third parties for unrelated marketing purposes. By using this feature, you acknowledge and agree that:

Responses are generated automatically and may not be accurate, complete, or appropriate for all situations;
The feature is provided for general support and informational purposes only;
You are solely responsible for decisions or actions you take based on any responses.
You will not use this feature if you are actively suicidal, going through detox, or need to go to the hospital.

You agree not to use the messaging feature to submit unlawful, abusive, or harmful content, or to attempt to interfere with or misuse the system. We may suspend or terminate access to the messaging feature if we believe it is being used in violation of these Terms. Use of the AI messaging feature is provided “AS IS” and “AS AVAILABLE,” and is subject to the limitations of liability and disclaimers set forth in these Terms.
